Answer: In order to be eligible for any of the pretrial programs, you have to have first a felony charge—they don’t accept misdemeanors—and they have to be non-violent charges. If you have violent charges in your history, those can keep you out of these diversion programs as well, and you have to not have applied and been part of drug court or the diversion programs within the past five years.
