How Do You Get an Attorney in Oklahoma?
You’ve probably heard Miranda Rights read a hundred times on television and in the movies. Once someone is under arrest, he or she will be Mirandized and advised that they have the right to remain silent and the right to request an attorney.
Your Constitutional Rights
The Fifth Amendment of the United States Constitution protects citizens from self-incrimination—that is, making statements during a police investigation that could be used against you in court.
Unfortunately, these rights are not always extended to everyone.
No Comma, No Lawyer
In one now-famous case in Louisiana, a man was denied an attorney because he used a slang term when asking for one. His exact words were:
“I know that I didn’t do it, so why don’t you give me a lawyer dog ‘cause this is not what’s up.”
The police did not give him a lawyer. In fact, the case made it all the way to the Louisiana Supreme Court, which ruled that a “lawyer dog” was too vague.
Could It Happen To Me?
If you are arrested or questioned by police, do not answer their questions. Simply ask for a lawyer and stop talking. If they do not listen, ask again. Never make any statements to police without the counsel of an attorney.
