Question: What is a motion to suppress in Oklahoma?

Answer: A motion to suppress is a motion to suppress evidence; it’s not necessarily the entire case itself, but you’re looking to attack some or all of the state’s evidence in a case. And if you’re successful, then whatever evidence you’re looking to suppress or attack, if it’s suppressed, that evidence cannot be used against your client at trial. An example would be if I had a client who had a DUI and I felt that I had an issue or some sort of a problem with the breath test, I could move to suppress the breath test. Now, that wouldn’t necessarily make the entire case go away, but it would make the breath test go away where they can’t use that against my client anymore.
